G2 Intelligence Article: Appeals Courts Supports Labs on Medical Necessity

I don't have a subscription to G2 Intelligence [for labs] but I can share their "top of the article" information on a recent  federal court case.   It looks like it tracks back to a case covered in December at Epstein Becker Green by Jampol et al. here.

"A federal appeals court upheld the idea that clinical laboratories can rely on physician orders to justify medical necessity."

Sounds like big news for labs.

"A recent appeals court ruling is giving clinical labs more clarity on medical necessity, but it also raises important questions about how test requisitions are designed and how sales commissions are structured."
